Website Privacy Policy

Empact Group (“the Company”) is committed to protecting the privacy of its employees and meeting its privacy obligations set out in the Privacy Act 1988 (Cth) (“the Privacy Act”), as they apply to it through business operations and activities conducted within Australia’s State and Territories and as obligated under the Australian Privacy Principles (“APPs”).

The Company collects personal information in order to conduct its business and comply with a range of legislative requirements. The purpose of this policy (“the Policy”) is to explain how the Company handles personal information of those who work with the Company and job applicants, in addition to the collection and use of personal information from clients, customers and visitors to the website, with a separate privacy policy used for company Employees. ‘The Website’ refers to pages accessed using the www.empactgroup.com.au url.

PERSONAL INFORMATION
Personal information is information relating to an individual which personally identifies an individual or makes the person's identity reasonably apparent. Personal information may also include ‘sensitive information’. For clarity, sensitive information may include:

  1. information or an opinion about an individual’s:
    1. racial or ethnic origin; or
    2. political opinions; or
    3. membership of a political association; or
    4. religious beliefs or affiliations; or
    5. philosophical beliefs; or
    6. membership of a professional or trade association; or
    7. membership of a trade union; or
    8. sexual orientation or practices; or
    9. criminal record;
    that is also personal information; or
  2. health information about an individual; or
  3. genetic information about an individual that is not otherwise health information; or
  4. biometric information that is to be used for the purpose of automated biometric verification or biometric identification; or 
  5. biometric templates.

Sensitive information may be required to be collected in some circumstances. The Company will only collect sensitive information if it is reasonably necessary for business purposes. In accordance with APPs, the Company will only collect sensitive information with your consent (unless otherwise permitted or required by law). All information collected will be used and disclosed by the Company only in accordance with this policy and relevant laws. The Company will take all reasonable steps to ensure that all personal information is held securely.

COLLECTION OF PERSONAL INFORMATION
The Company may collect personal information from individuals directly, or indirectly from publicly available sources if it is reasonably necessary in the course of the Company’s functions or activities. All collection of personal information will be conducted in accordance with APPs.

INFORMATION PROVIDED BY AN INDIVIDUAL
It is the Company’s usual practice to collect personal information from those who work with and for the Company, this is covered under Empact Group’s internal privacy policy. As part of the recruitment process, the Company may obtain information directly from a candidate as a result of their application to a job advertisement.

Furthermore, if a candidate’s application is successful, as a condition of employment with the Company, the successful candidate will likely be asked to provide evidence of their identity and legal entitlement to work in Australia. It is likely a successful candidate will also be asked to provide personal information, such as emergency contact details, tax file number, superannuation and bank account details, which will form part of an employee file.

INFORMATION PROVIDED BY OTHER SOURCES
Personal information may be provided as part of client engagements and/or business partners, in cases where it may be provided for the purpose of providing a service to them or their customers. This may be in data provided by clients, information collected at Empact Group hosted events, such as workshops or seminars or through surveys and market research. 

INFORMATION COLLECTED VIA THE WEBSITE
The company may collect personal information through interactions with the website and through the website host provider. This information may be collected when visiting the website, responding to website forms (such as the ‘Contact Us’ form) or contacting us by email. 

USE OF YOUR PERSONAL INFORMATION
The company may use your personal information for the purpose which it was collected and is necessary for legitimate business purposes. The information will not be used for any other purpose than which it was collected unless consented to or required by law. The company will always only use personal information in a reasonable manner.

Uses may include:

  • Communicating for the purpose of conducting business;
  • Recruitment and recruitment related purposes;
  • Management of employees and contractors in business operations;
  • Business related activities; and
  • As required to comply with legal obligations.

DISCLOSURE OF PERSONAL INFORMATION
The Company will only use and/or disclose your personal information for the purpose which it was collected (“the Primary Purpose”), unless otherwise required by law, as required to support the activities of an enforcement body, or with your consent. 

ACCURACY AND STORAGE OF PERSONAL INFORMATION
The Company will always endeavour to maintain an accurate record of all personal information it holds. Individuals should ensure that all personal information provided to the Company is accurate and up to date and notify the Company of any changes where required.
In addition, in order to ensure personal information is handled appropriately, the company will:

  • only access personal data as reasonably required for business operations;
  • not share personal data unless this is necessary for business operations and as part of the Primary purpose of collection (or as otherwise required by law);
  • keep personal data secure and protected;
  • where appropriate, ensure that highly sensitive personal data is encrypted before being transferred electronically to authorised external contacts; and
  • immediately report any loss, unauthorised access, security risk or other issue that arises in respect of personal information.

ACCESS TO PERSONAL INFORMATION
Personal information held by the Company in respect of employees is subject to the “employee records exemption” under the Privacy Act and does not have to be disclosed on request.

Other persons, such as job applicants, can request copies of their personal information by contacting people@empactgroup.com.au. The Company may make reasonable charges for access to personal information and may refuse to provide access to, or delete, personal information where this is required or authorised by the Privacy Act or another law.

If you believe that your personal information is incorrect, you may request that the Company amend its records. The Company will take reasonable steps to correct personal information when requested. 

RAISING A CONCERN OR A COMPLAINT
If you have any concerns about the use of your personal information (or of any other person’s personal information) you can contact the company through the contact details listed above.

The Company will generally ask for a concern or complaint to be put in writing and it will endeavour to provide a reply within 21 days.

INFORMATION PROVIDED BY A THIRD-PARTY
As part of the recruitment process, and with the candidate’s consent, the Company may seek information about a candidate through a third-party such as a recruitment service provider or a former employer. With the candidate’s consent, the Company may also seek information regarding:

  • prior employment history through reference checks;
  • eligibility to work in Australia through a visa status check;
  • educational qualifications by requesting confirmation of qualifications or results from an academic institution; 
  • interview records and details of any pre-employment assessments, including aptitude or other psychometric testing; and 
  • ability to perform the inherent requirements of the role, through medical and other allied health professionals, or criminal history check and/or working with children check.

The Company may also access personal information through publicly available networking sites such as Facebook or LinkedIn. Information may also be collected or provided by third party service providers, including contractors, recruitment agencies or suppliers engaged as part of business activities, where relevant, such as Empact hosted functions and workshops. 

USE OF PERSONAL INFORMATION
The purposes for which the Company may collect, use, and disclose personal information include (but are not limited):

  • to assess or respond to claims, complaints, or conduct, or co-operate with investigations when required;
  • to obtain professional services as required including legal, human resources, industrial relations, accounting and insurance services;
  • work-related administrative purposes;
  • work-related marketing purposes;
  • to confirm eligibility to work in Australia;
  • to make travel bookings on an individual’s behalf;
  • to comply with all applicable law;
  • the prevention and detection of fraud or other criminal offences;
    otherwise as permitted or required by law; or
  • otherwise with your consent.
